Antimonopoly Committee reveals violations in the transportation sector in Mykolaiv region

In Mykolaiv region, a village council chose a carrier without a competitive procedure. Antimonopoly authorities gave the local government 90 days to remedy the situation.

This was reported by the press service of the Southern Interregional Territorial Department of the Antimonopoly Committee of Ukraine.

During the inspection, it was found that the Arbuzyn village council did not hold a tender to determine a carrier for a public bus route within the community.

This violation allowed the municipal enterprise Arbuzynka Utility Plant to carry out passenger transportation on the Arbuzynka-Kirkletska route without competitive selection, which is contrary to the requirements of the current legislation.

On December 2, 2024, the administrative board of the committee provided recommendations to the Arbuzynka village council to stop the anti-competitive actions. They were recognized as a violation of Article 50(3) and Article 15(1) of the Law of Ukraine "On Protection of Economic Competition".

The village council has 90 days to consider these recommendations, remedy the situation and report on the measures taken.

Recently, the Mykolaiv Prosecutor's Office failed to terminate the agreement to supply equipment to the South Ukrainian NPP in court, and also failed to recover more than UAH 400,000 from a private company. However, in 2019, the Antimonopoly Committee found that the companies that participated in the bidding violated the law on protection of economic competition by using their actions during the preparation and participation in the procurement.

The Antimonopoly Committee also initiated a case against Mykolaivkomuntrans, a utility company. The utility company was suspected of establishing a monopoly and violating competition in the waste management industry. According to preliminary data from the antimonopoly authority, the company has held a dominant position in the market of solid waste collection and disposal services in Mykolaiv region for several years.

Two bidders were caught in the fraudulent procurement of heat meters for Mykolaivoblteploenergo. Violations were recorded during the participation of these entities in tenders held by utilities in different cities.
