Ukraine Approves Social Payments Procedure for Internally Displaced Persons

The Cabinet of Ministers of Ukraine has approved the Procedure for the appointment (restoration) of social payments to internally displaced persons by Resolution No. 365

The Cabinet of Ministers of Ukraine issued Resolution No. 365 dated 08.06.2016 approving the Procedure for the Allocation (Restoration) of Social Benefits to Internally Displaced Persons.

The Procedure defines the mechanism for granting (restoring) pensions (monthly lifetime allowance), lifetime state scholarships, all types of social assistance and compensation, material support, provision of social services, subsidies and benefits at the expense of the state budget and state social insurance funds.

As provided for in the document, social payments to IDPs are assigned and paid by the structural units for social protection of the population of district state administrations, executive bodies of city and district councils, as well as by the Pension Fund of Ukraine and state social insurance funds at the place of actual residence/stay of the IDP, regardless of the fact of registration of the place of residence/stay.

In order to appoint (restore) social payments, an IDP or his/her legal representative submits a relevant application to the body that provides social payments in the territory where the person is registered. The application must be accompanied by a copy of the IDP registration certificate and the original of such certificate.

In turn, the structural unit for social protection of the population, no later than the next business day after receiving the IDP's application, sends a request for the receipt of the electronic file of the recipient of social payments to the State Enterprise "Information and Computer Center of the Ministry of Social Policy of Ukraine", which sends the relevant electronic file within five business days from the date of receipt of such a request.

In order to assign (restore) social payments, the structural unit for social protection of the population within 15 working days from the date of receipt of the relevant IDP application or from the date of receipt of the application from the bodies that provide social payments, verifies the accuracy of the information specified in the application about the applicant's actual place of residence/stay The results of such verification are drawn up in the form of an act of inspection of material and living conditions, which is signed by all adult IDPs (their legal representatives) and representatives of structural units.

It is also stipulated that the unit for social protection of the population, within three working days from the date of receipt of the electronic file of the recipient of social payment, submits a proposal for the appointment (renewal) or refusal to appoint (renew) the relevant social payment, to which the aforementioned inspection report is attached, for consideration by the commissions established by the relevant district state administrations or executive committees. The decision of these commissions is the basis for the appointment (restoration) of social payments or for the refusal of these payments. In this case, the refusal of the commission to appoint (restore) the relevant social payment may be appealed in court.

The Resolution of the Cabinet of Ministers of Ukraine dated 08.06.2016 No. 365 entered into force on 14.06.2016.
