Odesa Court Fines Tairove Village Head ₴60,560 for Inaction on Road

The Odesa District Administrative Court fined the head of Tairovo village Timur Khasayev UAH 60,560 for inaction.
The relevant court ruling was published by journalist Iryna Hryb.
According to the document, the story began in 2023 when the court partially satisfied the claim of Zhanna Pozhydaieva, who stated that the village head had failed to act within his competence to build a road surface in accordance with building codes, state standards and norms on Pyvovarna Street in the village.
At the same time, Timur Khasayev was fined UAH 536.5, which the plaintiff was supposed to receive. And the village head was ordered to submit a report on the execution of the court decision of March 3, 2023, when Timur Khasayev was ordered to convene a council session and ensure that a decision on construction (asphalting) was made in accordance with established building codes and state standards. The court set the deadline by April 1.
It was necessary to:
- Amend the master plan of the settlement;
- Order the development of project documentation;
- Include in the list of local budget expenditures the costs of building a road surface on Pyvovarna Street in Tairove;
- Procure services through a tender procedure;
- Sign a contract with the winner of the tender;
- Pay for the services, sign the transfer acceptance certificates;
- Other necessary actions.
After that, the village council provided the court with several reports on the implementation of that decision, but the plaintiff petitioned that they did not fulfill what the court ordered. After reviewing the reports and motions, the court ruled in favor of the plaintiff and ordered the village head to submit a new report.
The issue in question was the preparation of design and estimate documentation for the object "New construction of the road from Pyvovarna Street to Stara Lustdorfska Street along the railway line and the M-27 highway in the 20th district of Tairove. The village council concluded an agreement on the development of this documentation with entrepreneur Taras Paches without using the electronic system. However, Prozorro now states that the agreement was terminated because the parties failed to fulfill it and the deadline for fulfillment had expired.
It is worth noting that the village head is supposed to pay half of the 60 thousand UAH fine to the plaintiff Zhanna Pozhydaieva, and the other half to the state.
Timur Khasayev became the head of the village council in 2020. He was supported by 23.17% of the voters who visited the polling stations, i.e. 1,327 people. His closest competitor was Larysa Burlaka, who was supported by 1,215 voters, or 21.22%.
Prior to that, Timur Khasayev was removed from the post of village head on August 22, 2019.
