Yuzhne City Council loses land case in the Supreme Court

The state managed to return two land plots with a total area of more than 3 hectares, which are actually the bottom of the Adzhalitsky estuary in Odesa region, to state ownership. After lengthy litigation, the Supreme Court of Ukraine put the final point in this case.
This was reported by the Judiciary of Ukraine.
According to the acts of the Cabinet of Ministers, these lands were transferred to the State Enterprise "Ukrainian Sea Ports Authority" for permanent use.
Back in 2017-2018, local governments and authorities illegally included these plots in the boundaries of the village of Novi Bilyary, and registered the right of communal ownership, although by law they should only be state-owned as part of the water fund.
To regain control of these lands, the Cabinet of Ministers instructed the Ministry of Justice to go to court. The case was won in the Economic Court of Odesa Oblast, and the appeal confirmed this. The Yuzhne City Council filed an appeal, but on April 29, 2025, the Supreme Court dismissed it, finally confirming the legality of the decisions of the courts of previous instances.
Earlier, Intent wrote that a 1.46-hectare water fund land plot was returned to state ownership. Its value was estimated at over UAH 65 million. It is also about the territory located at the bottom of the Great Adzhalitsky estuary, which is part of the Pivdennyi port. This land was previously leased by the Pivdennyi City Council for the construction of engineering infrastructure facilities.
The Large Adzhalitsky Estuary is a small saltwater body of water in southern Ukraine, in the Odesa region, about 12 km east of Odesa. It stretches for 8 km in length and has a width of 1 to 1.5 km. The depth is very shallow: on average less than half a meter, and maximum 1.2 meters.
The estuary is separated from the Black Sea by a narrow strip of sand. Since July 2001, a pipe has been laid between the estuary and the sea, allowing for limited water exchange. A small river, the Velykyi Adzhalyk, flows into the estuary. Several villages are located on its shores, including Vapnyarka, Nova Dofinivka, and Oleksandrivka. This estuary is considered one of the shallowest in the entire northwestern Black Sea region.
